WHAT IS IT ABOUT

Client instruction management failures occur when legal teams receive updated instructions through fragmented communication channels without a centralised system capturing every update against the matter record. The failure was internal: no mechanism to consolidate those communications into a single updated instruction set visible to every team member. An email received by one address is not an instruction received by the team.

PREVENTION FRAMEWORK

1. Log every client instruction update against the matter record — including any change of position or withdrawal of a previous instruction2. Require any material instruction received by any team member to be formally recorded and flagged to the responsible partner within 24 hours3. Hold a brief matter status call before any significant client-facing event to confirm the instruction set is current4. Assign one team member as instruction tracker on every complex matter5. Send written instruction confirmations to the client at regular intervals summarising the firm's current understanding

IF THIS HAS ALREADY HAPPENED

Confirm with the client in writing what was presented and seek confirmation of whether it accurately reflected their current position. If the client's position has changed, document the gap clearly and advise on the implications. Review how instruction updates were distributed within the team before the meeting.
